1. Telephone Consumer Protection Act (TCPA) Notice
L&M Custom Designs and Build (“we,” “us,” or “Company”) is committed to full compliance with the Telephone Consumer Protection Act (47 U.S.C. § 227), the FCC’s implementing regulations, and all applicable state telemarketing laws.
By providing your telephone number and checking the consent box on our consultation request form, you expressly consent to receive telephone calls and/or SMS text messages from L&M Custom Designs and Build, its agents, affiliates, and service providers at the telephone number(s) you provide, including calls made using an automatic telephone dialing system (ATDS) or prerecorded/artificial voice messages, for the purpose of:
- Confirming and managing your consultation appointment
- Providing project updates and follow-up communications
- Responding to inquiries you have submitted
- Sending promotional offers, design tips, and event invitations (only if you have opted in to marketing communications)
2. Consent Is Voluntary
Your consent to receive automated calls or text messages is not a condition of purchasing any goods or services from L&M Custom Designs and Build. You may choose to provide a different phone number for direct communication or contact us by email, mail, or through our website.
If you provide consent for marketing communications (optional checkbox), this is separate from the transactional consent and can be withdrawn independently at any time without affecting your service relationship with us.
3. How to Opt Out / Revoke Consent
You may revoke your consent at any time through any of the following methods:
- By Text: Reply STOP to any text message you receive from us. You will receive one final confirmation message.
- By Email: Send your opt-out request to info@lmcustomdesigns.com with subject line “STOP Communications.”
- By Phone: Call us at (512) 555-0180 during business hours (Monday–Friday, 8 AM–5 PM CT).
- By Mail: Write to: L&M Custom Designs and Build, Attn: Privacy/TCPA Opt-Out, Texas Hill Country, TX.
Once we receive your opt-out request, we will process it within 10 business days and cease all automated communications to the specified number. Transactional communications directly related to an active contract may continue as permitted by law.
4. Message Frequency & Rates
- Transactional messages: Typically 1–5 messages per appointment (confirmation, reminder, follow-up).
- Marketing messages (if opted in): Up to 4 messages per month.
- Standard message and data rates may apply depending on your mobile carrier plan.
- Reply HELP at any time for assistance or contact information.
5. FCC Compliance
L&M Custom Designs and Build complies with all FCC regulations governing telephone solicitation and marketing, including:
- Maintaining an internal Do-Not-Call list and honoring all opt-out requests promptly.
- Consulting the National Do-Not-Call Registry before placing marketing calls.
- Restricting telemarketing calls to the hours of 8:00 AM to 9:00 PM (recipient’s local time).
- Identifying ourselves at the beginning of every call with our company name and contact information.
- Never sending unsolicited text messages or making robocalls without prior express written consent.
6. Data Protection & Third Parties
Your phone number and contact information will not be sold, shared, or rented to third-party marketers. We may share your information with trusted service providers (e.g., appointment scheduling platforms, CRM systems) solely for the purpose of fulfilling communications you have consented to. All service providers are contractually required to protect your data and comply with TCPA and FCC regulations.

7. Your Rights
Under the TCPA and applicable state laws, you have the right to:
- Revoke consent for automated calls or texts at any time.
- Request to be placed on our internal Do-Not-Call list.
- File a complaint with the FCC if you believe your rights have been violated.
- Seek statutory damages of $500–$1,500 per violation under 47 U.S.C. § 227.
